ハワイ州政府教育局との「教育分野の協力に関する覚書」の
締結について
【概 要】
○ ５月 27 日（金）に県教育委員会とハワイ州政府教育局との間で，
教育分野の協力に関する覚書を締結します。
○ 覚書は，海外の自治体等と協力関係を構築し，姉妹校や短期留学プ
ログラム，教員研修などにおける生徒や教員の交流を通じて相互理解
の増進に資することを目的としています。
○ 県教育委員会として，海外の自治体と教育交流協定等を締結するの
は，ｵｰｽﾄﾗﾘｱ･ｸｲｰﾝｽﾞﾗﾝﾄﾞ州，台湾・桃園市ほかに次いで９例目です。

STATEMENT OF INTENT ON EDUCATION COOPERATION
BETWEEN
THE DEPARTMENT OF EDUCATION
STATE OF HAWAII
AND
THE HIROSHIMA PREFECTURAL BOARD OF EDUCATION
JAPAN
1. Purpose
1.1 The Department of Education, State of Hawaii and the Hiroshima Prefectural
Board of Education, Japan (the Parties) acknowledge the many cultural and
educational bilateral benefits that may be gained through the formation of
sister-school relationships, study tours, teacher exchange and other relevant
activities.
1.2 This Statement of Intent sets forth these understandings and signifies the
reciprocal intentions of the Parties to investigate possible collaboration in the area
of international education according to principles of equality and mutual benefit.
2. Guiding principles
2.1 The Parties agree to work cooperatively to the fullest possible extent, and to
investigate the potential for developing key alliances based on reciprocal
advantage and cordiality and in compliance with the laws prevailing in the
respective countries.
2.2 This Statement of Intent is not legally binding and merely constitutes a statement
of the mutual intentions of the Parties with respect to the document’s contents.
3. Areas of Possible Cooperation
3.1 Collaborative opportunities to be explored under the Statement of Intent are:
・capitalizing on the benefits gained from short term study tours and study abroad
by introducing participating schools from the Hiroshima Prefecture to public
schools in Hawaii looking to form linkages to Japan.
・ establishing avenues for communication with the intent of exploring the
development of sister-school relationships, teacher training and exchange, and
other relevant activities.
3.2 Sister-school relationships or teacher training and exchange arrangements may
also be agreed upon by the appropriate parties in separate documentation.
4. Term
4.1 Subject to item 4.2 below, this Statement of Intent will commence on the date the
last party signs this document and be in effect for three (3) years.
4.2 This Statement of Intent may be terminated by either Party at any time by notice in
writing to the other Party specifying an effective date of termination. The Parties
request that a Party wishing to exit this Statement of Intent give the other Party
three months’ notice if possible. If, at the end of the initial three-year term, neither
Party has terminated this Statement of Intent in accordance with this section 4.2,
the term of this Statement of Intent shall be extended for one additional three-year
period.
5. Variation
5.1 This Statement of Intent may be modified, amended, or extended by agreement in
writing by the Parties, and that modification, amendment, or extension will become
effective on the date specified in the Parties’ written agreement.
6. Effect of Document
This Statement of Intent:
・does not create a legally binding relationship between the Parties or impose legal
obligations on either Party;
・does not constitute or create a promise, representation, right, or obligation binding
on or in favor of either Party;
・contains no commitment or obligation on the part of either Party to proceed with
negotiations for or to enter into any agreement or other relationship; and
・does not preclude the Parties from signing other collaborative agreements.
Nothing in this Statement of Intent will be taken to constitute any relationship between
the Parties of principal and contractor, principal and agent, partnership, or any joint
venture between the Parties, and the Parties must not represent their relationship as
such.
This document is potentially subject to disclosure under the laws prevailing in the
respective countries.
This agreement is made in two copies and each party will retain one copy after its
signing. A Japanese language version is also attached for convenience.

教育分野の協力に関する覚書（和訳）
１ 目 的
1.1 日本国広島県教育委員会とアメリカ合衆国ハワイ州教育局（以下「両者」という。）は，
姉妹校,スタディ・ツアー，教員交流などの関係作りを通じて得られる数多くの文化的
及び教育的な相互の利益を確認するものとする。
1.2
この覚書は，こうした理解を明確にするとともに，平等と互恵の原則に基づき，国際
的な教育分野で見込まれる協力関係を模索しようとする両者の意思表示を行うものであ
る。
２ 基本原則
2.1
両者は，最大限，協力的に業務を遂行すること，また，両国の法令に則って相互の利
益と信心に基づく連帯関係を発展させる可能性を追究することに合意するものである。
2.2
この覚書は，法的な拘束力を有するものではなく，単に書面の内容をもって両者の意
向を公に表現するものである。
３ 見込まれる協力分野
3.1 この覚書より追究されるべき協働的事項
・
広島県から参加する学校を，日本との関係を構築しようとしているハワイ州の公立学
校に紹介することにより，教育旅行および留学から得られる利益を増進する。
・
両者は，姉妹校の関係，教員の研修・交流やその他関連する活動を発展させることを
追求する意図を持って，コミュニケーションを図る方策を確立する。
3.2 姉妹校提携，又は，教員研修・交流について具体的に合意する場合は，両者は，この覚
書ではなく，適切な当事者間でこれとは別の文書により合意する。
４ 期 間
4.1 次の 4.2 項を前提として，この覚書は一方が最後にこの文書に署名する日に開始され,
３年間有効とするものとする。
4.2
この覚書は，一方が，終了時期を規定した書面によりもう一方に対して通知すること
により終了する。この覚書を終了する意向のある者は，もう一方に対して可能であれば
３ヶ月前に通知することを求めるものである。仮に，当初の３年間の満了時において，
この 4.2 項にしたがって，いずれか一方がこの覚書を終了させない限りは，さらに３年
間延長するものとする。
５ 特記事項
5.1
この覚書は，両者が書面により合意することにより，改正，修正又は延長されるもの
とする。その場合の改正，修正又は延長は，両者が合意した日をもって効力が発生する。
６ 書面の効果
この覚書は，
・
両者間の関係を法的に拘束するものではなく，また，一方に対して法的な義務を課す
ものではない。
・
もう一方に対し，又は，もう一方のために，いかなる約束，表明，権利，義務を規定
させ，又は生じさせるものではない。
・
もう一方に対し，いかなる合意，その他関係に至らしめる，又はそれに向けた交渉を
進めるための意思や義務を含むものではない。
・ 両者が他の協力関係の合意書に署名することを妨げるものではない。
この覚書には，何ら両者自身と契約者，両者自身とエージェント，協働関係者又は両
者のジョイント・ベンチャーの間のいかなる関係をも規定するための措置はない。
また，両者は上記のような関係を代表してはならない。
この文書は，両国の法令に則って，公開される可能性を有するものである。
この文書は，２部作成され，署名後，双方が１部を保有する。日本語版も参照用とし
て添付する。
