Recent changes to immigration rules
英語要項に関する書類について
ビザの申請条件に英語要項が含まれる場合、
2013年7月1日以降の申請から英語試験の
合格証明書やスコア証明書などの原本を提
出する必要が無くなりました。しかし、試
験によっては引き続きスコア証明のコピー
を求められる等、提出書類の条件が異なる
ことがあります。弊所のビザ申請サポート

クロアチアのEU加盟について
2013年7月1日、クロアチアが正式にEU加
盟を果たしました。英国は経過措置として
クロアチア国籍保持者に対して就労を制限
しており、クロアチア国籍保持者は特例で
免除されない限り、Home Officeに労働許
可(worker authorisation)を申請することが
義務付けられています。クロアチア国籍保
持者の採用を決定する際、当該個人が
worker authorisationの承認を受けている
か確認することが大変重要です。
Indefinite Leave to Remain (永住権)
の申請条件について
現状の英国イミグレーションルールでは、
旧労働許可証(Work Permit)、高度技術者
プログラム(HSMP)、Tier 2 General、
2010年4月5日までに発給された初回Tier 2
ICTビザ等の就労ビザを持って英国の滞在
が満5年に至る外国人は"Indefinite Leave
to Remain (ILR)"の申請が認められていま
す。申請は滞在が満5年に至る28日前から
受理されますが、Work Permitが4年11ヶ
月強の期間で発行されている等、ビザの期
間が満5年を満たさないケースもあります。
この様なケースの場合、英国の滞在が満5
年の28日以内に入ったらILRの申請が受け
付けられるのか、若しくは一旦Tier 2ルー
トで滞在を延長し、有効ビザの期限が通算
で満5年を満たさなければILRの申請が受
理されないのかが明確にされておりません
でした。PwCリーガルよりHome Officeに
この部分を明確にするよう求めたところ、
先述に挙げた例の様に就労ビザの期限が5
年に満たない場合でも、実際の滞在が満5
年の28日以内に入ったらILRの申請は受理
されると回答を得ました。
