第 13 条
報酬に関する基準
1.報酬は次の基準をその列挙憲序には関係なく考慮して、救助作業を奨励する目的をもって決定する。
(a)船舶及びその他の財産の被救助価額
(b)環境損害を防止し、 又は軽減するについての救助者の技能及び努力
(c)救助者によって達成された成功の度合
(d)危険の性質及び程度
(e)船舶、その他の財産及び人命を救助するについての技能及び努力
(り救助者の費やした時間並びに負担した費用及び損失
(g )救助者またはその設備が冒した責任負担及びその他の危険
(h)行なわれた作業の迅速性
(i)救助作業のために予定された船舶又はその他の設備の利用可能性及び効用
6)救助者の設備の準備態勢及び有効性並びにその価値
2 .第 l 項に基 づいて決定された報酬は、船猫及びその他の財産の利害関係人のすべてによって、それぞれの被救助
価額の割合に応じて支払われるものとする。
3 .報酬はそれに加えて支払うべき利息及び回収可能な訴訟費用を除いて、船舶及びその他の財産の被救助価額を越
え て は な らな い。
