商品及び役務の区分について （１）商品及び役務の分類の必要性 我が国商標法は、登録主義を採用し、商標法に基づいて商標が登録されることにより、 全国的に効力が及ぶ独占排他的な権利、すなわち「商標権」という権利が付与されます。 ところで、世の中には極めて多数の商品や役務（サービス）があり、この商標権を個々 の商品・役務ごとに付与するとなると、極めて多数の商標権が発生することとなり、出願 人の手続、特許庁における審査等がいずれも煩雑となります。 また、一つの商標権で無限定に数多くの商品・役務が包含するとなると、商標を使用し ない商品・役務についてまで商標権を付与することとなり、先行商標のサーチ負担が増大 するばかりでなく、第三者の商標選択の幅を狭めることとなります。 そこで、このような弊害を除去し、出願手続や事務処理、商標管理等を円滑に行うため に商品・役務を系統的に整理した商品・役務分類が必要となります。 （２）商品及び役務の分類の変遷 我が国の商品・役務分類は、明治１７年（１８８４年）の商標条例制定以来、これまで 数次にわたって改正されています。 このような改正は、経済発展や技術進歩等を背景に、新製品の開発・出現、商取引の実 情の変化、国際貿易の進展等、その時代の経済社会の実体を反映させるため行われてきた ものといえます。 （３）現行の商品及び役務の区分 現行の商品及び役務の区分は、平成３年（１９９１年）の改正により、それまでの日本 分類からニース協定に基づく国際分類に即したものとなっており、商標法施行令第１条の 別表(以下、これを「政令別表」といいます。)と商標法施行規則第６条の別表(以下、これ を「省令別表」といいます。)とで構成されています。 （Ａ）政令別表（参考資料６参照） 政令別表は、商標法第６条第２項にいう「商品及び役務の区分」であり、国際分類にし たがって４５の区分（第１類～第３４類が商品の区分、第３５類～第４５類が役務の区分） に分類され、各区分には国際分類の類別表を踏まえた名称が付されています。 また、商標法施行令第１条は、「各区分に属する商品又は役務の区分は、国際分類に即 して経済産業省令で定める。」と規定し、各区分に属する詳細な商品又は役務は省令に委 任しています。 -3- （Ｂ）省令別表（参考資料７参照） 省令別表は、商標法施行令第１条に基づき各区分に属すべき商品又は役務を定めるもの です。商品及び役務を国際分類に即して各区分ごとに整理し、それをさらに適宜区分けし た形で例示することにより規定しています。 ここに掲載されている商品及び役務の表示は、商標登録出願において商品又は役務を指 定する際の便宜を考慮して、指定商品又は指定役務の表示として使用できるものとなって います。 また、個別の商品及び役務の区分の確認を容易にするため、可能な範囲内での概念括り （個々の商品又は役務を包括する商品又は役務の表示の掲載）がなされています。 （４）「商品及び役務の区分」の法律上の意義 平成８年（１９９６年）に改正された商標法では、従来の一出願一区分制を廃止し、平 成９年（１９９７年）４月１日から、一出願多区分制を採用しています。 （Ａ）一出願一区分制のもとでの法律上の意義 改正前は、商標法第６条第１項の規定により、１の区分内の商品又は役務であれば複数 の商品又は役務を指定することができましたが、２以上の区分の商品又は役務を一の出願 で指定することはできませんでした。 したがって、｢商品及び役務の区分｣の法律上の意義は、一出願で同時に指定し得る商品 又は役務の範囲ということでした。 （Ｂ）一出願多区分制のもとでの法律上の意義 現在は、商標法第６条第２項の規定により、商品及び役務の区分に従っていれば、多区 分にわたる商品又は役務を一出願で指定することも可能ですから、一出願一区分制のよう な法律上の意義はありません。 一方、一出願多区分制下では、料金(出願料、登録料等)は区分の数に応じて徴収するこ とから、｢商品及び役務の区分｣の法律上の意義は、料金算定の基礎(料金徴収単位)という ことになります。 （出願手数料:3,400 円＋区分数×8,600 円 平成２０年（２００８年）６月１日改正：引き下げ） (５)その他 商標法第６条第２項(商品又は役務の指定は、政令で定める商品及び役務の区分に従って しなければならない)違反は拒絶理由となっているため、区分ごとに区分けしていない出願 は拒絶されます(商標法第１５条第３項)。 なお、商標登録の登録異議申立て及び無効審判において、この商標法第６条第２項違反 は異議・無効理由となっていません。 これは、出願段階では区分ごとに区分けることとしていますが、区分は出願手続や事務 -4- 処理、料金徴収単位等の便宜上の要請から設けられていることから、いったん商標登録が あった以上、その権利の存続を認めても第三者に実害がないとの理由に基づくものです。 第２章 ニース協定に基づく国際分類 （１）ニース協定の概要 ニース協定は、締約国が商標及びサービスマークの登録のための商品及びサービスの分 類として各国共通の国際分類を採用することを目的に、パリ条約第１９条の特別取極(同盟 国は、この条約の規定に抵触しない限り、別に相互間で工業所有権の保護に関する特別の 取極を行う権利を留保する。）として、１９５７年にニースで締結された協定であり、１ ９６１年４月８日に効力を生じました。 その後、１９６７年にストックホルムで、１９７７年にジュネーヴで改正され、さらに、 １９７９年にジュネーヴで修正されて現在に至っています。 正式名称を「１９６７年７月１４日にストックホルムで及び１９７７年５月１３日にジ ュネーヴで改正され並びに１９７９年１０月２日に修正された標章の登録のための商品及 びサービスの国際分類に関する１９５７年６月１５日のニース協定」といいます。 この協定は、商品及びサービスの分類が国によって相違していると、先行商標の調査、 商標登録出願手続等商標管理について種々煩雑さがあることから、国際的に共通な分類(国 際分類)を採用することを目的に締結された協定で、締約国に国際分類の採用を義務づけて います。協定本文は全１４条からなっています(参考資料１参照）。 （２）国際分類の概要 （Ａ）国際分類(International Classification) 国際分類とは、ニース協定に規定する標章の登録のための商品及びサービスに関する国 際的に共通の分類をいいます。 国際分類の実体である（ａ）類別表及び（ｂ）アルファベット順の一覧表は、ニース協 定の一部を成すものとしては規定されていませんが、ニース協定にとっては重要な事項で あるので、ニース協定で国際分類の構成、用語等について規定しています。 国際分類は、 （ａ）類別表(注釈が付されている場合には、その注釈を含む。) （ｂ）商品及びサービスのアルファベット順の一覧表 から構成されています。 （ａ）類別表(List of Classes) 類別表は、商品及びサービスの類別を定めたものであって、各類ごとにその類に属す る商品又はサービスの概要を示すものであり、一般的注釈(General Remarks)、類見出し （Class Headings）、注釈 (Explanatory Note) から成っています。 -5- ☆ 一般的注釈(General Remarks) 一般的注釈は、類別表及びアルファベット順の一覧表のいずれによっても所属する類 が明らかでない商品及びサービスについて、所属する類を判断する基準を示すもので す（参考資料２参照）。 ☆ 類見出し（Class Headings）及び注釈(Explanatory Note) 類見出しとその注釈は、商品に関する３４分類(第１類～第３４類)及びサービスに関 する１１分類(第３５類～第４５類)それぞれについて記載されています。 類見出しは、各類に所属する商品及びサービスの概要を示したもので、注釈は、類別 表を説明するものです。これらは、分類の決定等を容易にするために類別表に付され ているものです（参考資料３参照）。 （ｂ）商品及びサービスのアルファベット順の一覧表(Alphabetical list of goods and services) 商品及びサービスのアルファベット順の一覧表は、商品の一覧表及びサービスの一覧 表から成り、商品及びサービスの品目をアルファベット順に列挙し、個々の商品又はサ ービスごとにそれが所属する類を表示するものであって、個々の商品又はサービスが国 際分類のいずれの類に属するかを決定する際の便宜に資するものであり、(ⅰ)全ての類 (商品第１類～第３４類;サービス第３５類～第４５類)を通じて、商品及びサービスの品 目をアルファベット順に列挙した全類通しアルファベット順一覧表と(ⅱ)各類ごとに、 その類に属する商品及びサービスの品目をアルファベット順に列挙した類別アルファベ ット順一覧表があります(参考資料４参照）。 （Ｂ）国際分類の正文 国際分類の正文は、英語及びフランス語です。 さらに、アラビア語、ドイツ語、イタリア語、ポルトガル語、ロシア語、スペイン語及 び同盟の総会が指定する他の言語（日本語を含む。）による国際分類の公定訳文が作成さ れます。 ＊ 商品・サービス国際分類表〔第 10-2014 版〕は、特許庁ホームページ（http://www.j po.go.jp/shiryou/kijun/kijun2/kokusai_bunrui_10-2014.htm）をご参照ください。 （３）我が国のニース協定への加入と国際分類の本格的採用 知的所有権の国際的ハーモナイゼーションの一環として、我が国は以下のような理由か らニース協定に加入することとし、平成元年（１９８９年）の第１１４国会において加入 の承認を得、平成２年（１９９０年）２月２０日に我が国について加入の効力が生じまし た。 -6- ａ）国際的な経済活動が一層活発化しているのに伴い、我が国から外国に対し、あるいは 外国から我が国に対する商標登録出願が増加しつつあるところ、国際分類を採用すること により、すでに登録されている又は出願されている商標についての事前調査、出願の手続 き等の商標管理を容易にし、このような外国出願の円滑化を図る必要がありました。 ｂ）当時、すでにニース協定へはアメリカ、イギリス、フランス、ドイツをはじめ３３か 国が加入し、さらに、実際に国際分類を採用している国も１００か国を越えるなど国際分 類の採用が国際的趨勢となっており、我が国も国際分類を採用するよう諸外国から指摘を 受けていました。 ニース協定への加入当初は、昭和３４年（１９５９年）法の日本分類を使用しつつ、国 際分類への理解と習熟を深めるため、国際分類を副次的体系として使用したため、商標公 報及び商標登録原簿に商標法施行令で定める商品の区分のほかに国際分類の類の番号が併 記されていました。 その後、サービスマーク登録制度が施行された平成４年（１９９２年）４月１日からは、 国際分類を主たる体系としての使用に移行しました。 国際分類を主たる体系として使用するに当たっては、我が国の分類を定める政令別表及 び商標法施行規則第３条別表(旧省令別表)を国際分類に即したものに改正しました。 これ以降も、主として国際分類の変更に対応するため、以下のとおり政令別表あるいは 省令別表を改正しています。 平成８年改正 ：平成９年（１９９７年）１月１日発効の国際分類第７版に対応 平成１３年改正：平成１４年（２００２年）１月１日発効の国際分類第８版に対応 平成１８年改正：平成１９年（２００７年）１月１日発効の国際分類第９版に対応 平成２３年改正：平成２４年（２０１２年）１月１日発効の国際分類第１０版に対応 平成２４年改正：平成２５年（２０１３年）１月１日発効の国際分類第１０版の新追加 版（１０－２０１３版）に対応 平成２５年改正：平成２６年（２０１４年）１月１日発効の国際分類第１０版の新追加 版（１０－２０１４版）に対応 第３章 国際分類の変更 (１)国際分類の変更 国際分類の変更は、専門家委員会が行います。 国際分類の変更とは、類別表の変更、注釈の変更、アルファベット順の一覧表の商品又 はサービスの追加、削除、表現の変更、商品又はサービスのある類から他の類への移行又 は類の新設をいいます。このうち、「商品又はサービスのある類から他の類への移行又は 類の新設」は、条約上特に「修正」と定義されており専門会委員会に出席した締約国の５ 分の４以上の多数で決定されます。その他の決定事項は、単純過半数で決定されます。 国際分類は、これまでに数次変更されており、現在は、２０１４年（平成２６年）１月 -7- １日に発効した第１０版の新追加版(第１０－２０１４版）が使用されています（第１版１ ９６３年（昭和３８年）、第２版１９７１年（昭和４６年）、第３版１９８１年（昭和５ ６年）、第４版１９８３年（昭和５８年）、第５版１９８７年（昭和６２年）、第６版１ ９９２年（平成４年）、第７版１９９７年（平成９年）、第８版２００２年（平成１４年）、 第９版２００７年（平成１９年）及び第１０版２０１２年（平成２４年））。 （Ａ）専門家委員会（CE：Committee of Experts）の役割（第３条、第４条より抜粋） １）国際分類の変更を決定することや、同盟国に対する勧告や国際分類の付与を容易に することに役立つすべての措置をとること。 ２）小委員会・作業部会を設置すること。 ３）国際分類の変更の提案を行うことを可能とする国、機関の要請をすること。 ４）「ニース協定専門家委員会手続規則」改訂の決定をすること。 ５）「国際分類の変更」を決定し、各国提案の発効の日を定めること。 （Ｂ）国際分類の変更作業 国際分類の変更は、各締約国より電子フォーラムを利用して随時提案されます。 そして、毎年１０月３１日を期限として国際事務局（世界知的所有権機関（ＷＩＰＯ）） により取りまとめが行われ公表されます。各締約国は公表された提案に対して期限内にコ メントをすることができ、最終的に、毎年４月末頃にＷＩＰＯ本部（スイス、ジュネーブ） で開催される専門家委員会において決定します。 -8- 【第２１回専門家委員会で決定されたニース国際分類の改正作業】 《従前》 2007.01.01 2007.01.01 ～ 2011.12.31 ９版 各 国 提 案 公表しています。ここでは、類似商品・役務審査基準、アルファベチカルリストの他に、 日米欧の三極で合意した商品・役務表示のリスト（三庁リスト*1）及び国際登録出願に於い てＷＩＰＯで採用可能とされた商品・役務表示（Ｇｏｏｄｓ ＆ Ｓｅｒｖｉｃｅｓマネー ジャーデータ）も検索可能です（３ 商品・役務の検索について（２１ページ）参照）。 第４章 日本分類と国際分類 （１）日本分類の区分の考え方 （Ａ）商品区分の分類基準 昭和３４年（１９５９年）法前の商品の類別においては、原材料主義・生産者主義を原 則としていましたが、昭和３４年法の商品区分においては、原則として用途主義・販売店 義を採用しました。このことは商品の類似関係は材料、生産者によるよりも用途、販売に よって判断される度合が強くなる傾向にあったからです。 また、取引界において企業が関連業種への拡張を行う傾向にあるので、７０類別ではあ まりに細分化されすぎており、実情に即しなくなったため、商品区分においては類の規模 を大きくし、数を少なくして３４類としました。 また、類の配列についても、３４の類を、化学品関係、金属及び機械関係、繊維関係、 日用品関係、食料品関係の５グループに大別し、この順序に従って、類を配列しました。 （Ｂ）昭和３４年法の商品区分（日本分類は、商品の区分のみ） → 参考資料５を参照してください。 （２）国際分類の区分の考え方 （Ａ）政令別表作成の考え方 平成３年（１９９１年）改正時に作成した政令別表の形式及び内容についての考え方は、 次のとおりです。 ☆ 国際分類を主たる体系として採用しますので、国際分類の類別表に従います。 ☆ 各区分において、国際分類の類別表の「類の見出し」及び「注釈」を踏まえ、代表的 な名称付けを行います。 具体的手順は次のとおりです。 (ａ)各類の名称を端的に表すものとして、「類の見出し」上の表示のみで対応できる ものは、「類の見出し」から採用することとします。 *1三庁リストとは、日米欧の商標担当庁が相互に認めることができる商品・役務表示をリスト化したものです。このリ スト化には 2012 年より韓国も参加しており、参加国を拡大するべく活動しています。 - 10 - (ｂ)「類の見出し」上の表示が、抽象的な内容であったり、表示が長すぎる等、類の 名称付けとしては適切ではない場合には、「注釈」上の表示も採用の対象としま す。 その際、「注釈」中の「主として含む」とされている表示を採用の対象とし、 「特に含む」とされている表示は採用の対象としません。 (ｃ)前記(ａ)及び(ｂ)を基本としつつ、政令別表、その他の法令用語、日本標準商 品分類等の使用例を確認の上、類の名称付けとしてより適切な表現とします。 ☆ 各区分に属する詳細な商品又は役務は省令別表に委任します。 （Ｂ）例外（第２８類及び第４０類）の政令表示の考え方 【第２８類】 第２８類の類見出し上の表示は、抽象的な内容であり、類の名称付けとして必ずしも適 切でないこと、また、注釈中の「主として～含む」とされている表示がなく、上記作成手 順のとおりに名称付けが困難であることから、類見出しから判断し、「ゲーム用具及びお もちゃ」「体操用具及び運動用具」「クリスマスツリー用装飾品」と同義若しくは包含さ れる商品である「人形」「がん具」「パズル」「クリスマス用品」「身体トレーニング用 具、体操用具及び競技用具」「釣りざお」等を物品としている「がん具、遊戯用具及び運 動用具」（関税定率法別表 第９５類）の表現（法令用語）を採用しました。 【第４０類】 第４０類の類見出し上の表示は、抽象的な内容であり、類の名称付けとしては必ずしも 適切ではないこと、また役務の他の類の政令別表の表示は類見出しから採用していること から、注釈中の「主として～含む」における「物品又は物質の加工又は変形」の内、物質 は物品とほぼ同義であること、及び加工、変形のみに限定すると狭すぎることから、「物 品の加工」を例示として掲載し、その包括表示として「その他の処理」を用いました。 なお、「物品の加工」(家内労働法，工場立地法，工業用水法，地方税法，工業用道事業 法等)及び「処理」(マンションの管理の適正化の推進に関する法律，原子力発施設等立地 地域の振興に関する特別法，高度情報通信ネットワーク社会形成基本法，国倒産処理手続 の承認援助に関する法律等)は法令用語として使用されていますが、 「物品の変形」及び「物 質の変形」は法令用語として使用されていません。 - 11 - ２ 類似商品・役務審査基準について 第１章 商標法と類似商品・役務審査基準 （１）商標法第６条について 商標登録出願をする場合には、その商標を使用する商品又は役務を指定する必要があり （商標法第６条第１項）、その指定は、政令で定める商品及び役務の区分に従ってしなけ ればならないと規定されています（商標法第６条第２項）。 当該規定の委任を受け、政令別表において商品及び役務の区分が規定されており、各区 分に属する具体的な商品及び役務の詳細については、国際的な商品及び役務の区分を定め るニース協定に規定される分類（国際分類）に即して、省令別表で具体的に例示していま す。 ＊ 商標法第６条 第六条 商標登録出願は、商標の使用をする一又は二以上の商品又は役務を指定し て、商標ごとにしなければならない。 ２ 前項の指定は、政令で定める商品及び役務の区分に従つてしなければな らない。 ３ 前項の商品及び役務の区分は、商品又は役務の類似の範囲を定めるもの ではない。 ＊ 商標法施行令第１条 第一条 商標法第六条第二項の政令で定める商品及び役務の区分は、別表のとおり とし、各区分に属する商品又は役務は、千九百六十七年七月十四日にストックホル ムで及び千九百七十七年五月十三日にジュネーヴで改正され並びに千九百七十九 年十月二日に修正された標章の登録のための商品及びサービスの国際分類に関す る千九百五十七年六月十五日のニース協定第一条に規定する国際分類に即して、経 済産業省令で定める。 ＊ 商標法施行規則第６条 第六条 商標法施行令（昭和三十五年政令第十九号）第一条の規定による商品及び 役務の区分（以下「商品及び役務の区分」という。）に属する商品又は役務 は、別表のとおりとする。 - 12 - なお、商標法第６条第３項は、｢商品及び役務の区分は、商品又は役務の類似の範囲を定 めるものではない。｣と規定しています。 したがって、２つの商品又は役務がそれぞれ区分を異にするときでも、類似関係にある 場合があり、また、商品と役務が類似することもあります(第２条第６項)。 （２）省令別表と類似商品・役務審査基準の関係 省令別表は、商品及び役務の区分に属する商品又は役務を記載したものです。 類似商品・役務審査基準（以下「類似基準」といいます。）は、商品や役務の類否を判 定する一般的基準である商品の生産部門・販売部門の共通性、原材料・品質の共通性、用 途の共通性、需要者の範囲の共通性及び完成品・部品の関連性や役務の提供の手段・目的 又は場所の共通性、提供に関連する物品の共通性、需要者の範囲の共通性及び業種の共通 性等を各商品・役務ごとに検討を行い、各商品と類似する商品、各役務と類似する役務の 類否関係を整理したものです（参考資料８参照）。 （３）類似基準について 出願された商標が、他人の登録商標と同一又は類似の商標であって、かつ、出願に係る 指定商品又は指定役務が同一又は類似のものである場合は、商標登録を受けることはでき ません。 ＊ 商標法第４条第１項第１１号 当該商標登録出願の日前の商標登録出願に係る他人の登録商標又はこれに類似する 商標であって、その商標登録に係る指定商品若しくは指定役務（第６条第１項（第 68 条第１項において準用する場合を含む｡)の規定により指定した商品又は役務をいう。 以下同じ。）又はこれらに類似する商品若しくは役務について使用をするもの そして、特許庁では、出願された商標が前記拒絶理由に該当するか否かを審査するに当 たり、出願された商標の指定商品又は指定役務と他人の登録商標の指定商品又は指定役務 との類否を、原則として、類似基準に基づいて判断しています。 類似基準は、互いに類似すると推定される商品及び役務をグルーピング化したもので、 同じグループの商品又は役務には、数字とアルファベットの組み合わせからなる共通のコ ードである類似群コードが付され、同じ類似群コードが付された商品及び役務については、 審査において類似と推定されます。 - 13 - ＊ 商標審査基準 商標法第４条第１項第１１号（先願に係る他人の登録商標）（抜粋） 11．商品の類否を判断するに際しては、次の基準を総合的に考慮するものとする。この場 合には、原則として、類似商品・役務審査基準によるものとする。 (ｲ) 生産部門が一致するかどうか (ﾛ) 販売部門が一致するかどうか (ﾊ) 原材料及び品質が一致するかどうか (ﾆ) 用途が一致するかどうか (ﾎ) 需要者の範囲が一致するかどうか (ﾍ) 完成品と部品との関係にあるかどうか 指定商品又は指定役務は、登録商標と同様に商標権の専用権、禁止権を定める上で極め て重要となります。そこで、指定商品又は指定役務について、互いに類似する商品又は役 務であると推定されるものを「類似する商品群」又は「類似する役務群」として、これら を公表しています。 この「類似する商品群」又は「類似する役務群」には、類似群コードと呼ばれる５桁の コードがつけられています。類似群コードは、「先願・既登録調査」「権利範囲の確認」 「拒絶理由解消のための指定商品又は指定役務の補正」「他人の登録商標との権利の抵触 の有無の判断」等に利用されています。 （Ａ）商品の類似群コード 商品の類似群コードは、類似商品審査基準による大分類、中分類に沿って以下のように 定められています。 （３）類似基準の運用 （Ａ）類似の推定 類似基準は、関係団体等の意見を踏まえて商標審査部内において検討し、決定した ものです。 類似基準において□（四角カッコ）で囲った見出しの商品又は役務に含まれるも のは、原則として、互いに類似商品又は類似役務であると推定します。 類似基準は全審査官の統一的基準ですが、具体的、個別的に商品又は役務の類否 を審査する際において、あるいは商取引、経済界等の実情の推移から、この基準で類 似と推定したものでも非類似と認められる場合又はこの基準では類似としていないも のでも類似と認められる場合もあり得ます。 （Ｂ）他類間類似・備考類似 類を超えた類似商品・役務（他類間類似）及び「備考」で類似するとされた商品・ 役務（備考類似）については、以下のとおりとします。 （ａ）他類間類似 □（四角カッコ）の下の［ 願については、類似と推定する商品の範囲もクロス・サーチを行い、商品が指定された 出願については、類似と推定する小売等役務の範囲もクロス・サーチを行います。 （Ｄ）複数の類似群コードが付された商品及び役務の運用について 複数の類似群コードが付された商品及び役務は、特に備考欄に記載がある場合を除 き、①同一の複数の類似群コードが付された商品・役務、又は②そのうちの一の類似群 Ａ０１）及び「写真 写真立て」（２６Ｄ０１）のそれぞれの商品に類似と推定し ます。 - 18 - 第３章 省令別表及び類似基準〔国際分類第１０－２０１４版対応〕 の改正 （１）省令別表の一部改正について 平成２６年１月１日からの国際分類第１０－２０１４版の発効に伴い、それに即して省 令別表を改正し、同日付けで施行しました（平成２５年１２月２日経済産業省令第５８号）。
