PARTICIPANT WAIVER AND RELEASE OF LIABILITY,
ASSUMPTION OF RISK AND INDEMNITY AGREEMENT

For and in consideration of USA Track & Field, Inc. (“USA Track & Field”) allowing me, the undersigned, to participate in the USA Track &
Field sanctioned event described above (the “Event” or “Events”); I, for myself, and on behalf of my spouse, children, guardians, heirs
and next of kin, and any legal and personal representatives, executors, administrators, successors and assigns, hereby agree to and make
the following contractual representations pursuant to this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement
(the Agreement”);
1. I hereby represent that (i) I am at least eighteen (18) years of age or older; (ii) I am in good health and in proper physical condition to
participate in the Event; and (iii) I am not under the influence of alcohol or any illicit or prescription drugs which would in any way impair
my ability to safely participate in the Event. I agree that it is my sole responsibility to determine whether I am sufficiently fit and healthy
enough to participate in the Event, that I am responsible for my own safety and well being at all times and under all circumstances while
at the Event site.
2. I understand and acknowledge that participation in track & field, road running, race walking, cross country, mountain, ultra, and trail
running Events is inherently dangerous and represents an extreme test of a person’s physical and mental limits. I understand and
acknowledge the risks and dangers associated with participation in the Event and sport of track & field and related activities, including
without limitation, the potential for serious bodily injury, sickness and disease, permanent disability, paralysis and loss of life; loss of or
damage to equipment/property; exposure to extreme conditions and circumstances; contact with other participants, spectators, animals
or other natural or manmade objects; dangers arising from adverse weather conditions; imperfect course or track conditions; land, water
and surface hazards; equipment failure; inadequate safety measures; participants of varying skill levels; situations beyond the immediate
control of the Event Organizers; and other undefined, not readily foreseeable and presently unknown risks and dangers (“Risks”). I
understand that these Risks may be caused in whole or in part by my own actions or inactions, the actions or inactions of others
participating in the Event, or the negligent acts or omissions of the Released Parties defined below, and I hereby expressly assume all
such Risks and responsibility for any damages, liabilities, losses or expenses which I incur as a result of my participation in any Event.
3. I agree to be familiar with and to abide by the Rules and Regulations established for the Event, including but not limited to the
Competitive Rules adopted by USA Track & Field and any safety regulations established for the benefit of all participants. I accept sole
responsibility for my own conduct and actions while participating in the Event, and the condition and adequacy of my equipment.
4. I hereby Release, Waive and Covenant Not to Sue, and further agree to Indemnify, Defend and Hold Harmless the following parties:
Sedona Marathon Event, Sedona Chamber of Commerce and its Director’s, members, USA Track & Field, Inc., its members, member clubs,
associations, sport disciplines and divisions; United States Olympic Committee (USOC); the Event Directors, Organizers and Promoters,
Sponsors, Advertisers, Coaches and Officials; the Host Organization and the Facility, Venue and Property Owners or Operators upon
which the Event takes place; Law Enforcement Agencies and other Public Entities providing support for the Event; and each of their
respective parent, subsidiary and affiliated companies, officers, directors, partners, shareholders, members, agents, employees and
volunteers (Individually and Collectively, the “Released Parties” or “Event Organizers”), with respect to any liability, claim(s), demand(s),
cause(s) of action, damage(s), loss or expense (including court costs and reasonable attorneys fees) of any kind or nature (“Liability”)
which may arise out of, result from, or relate in any way to my participation in the Event, including claims for Liability caused in whole or
in part by the negligent acts or omissions of the Released Parties. I further agree that if, despite this Agreement, I, or anyone on my
behalf, makes a claim for Liability against any of the Released Parties, I will indemnify, defend and hold harmless each of the Released
Parties from any such Liabilities which any may be incurred as the result of such claim.
I hereby warrant that I am of legal age and competent to enter into this Agreement, that I have read this Agreement carefully,
understand its terms and conditions, acknowledge that I will be giving up substantial legal rights by signing it (including the rights of my
spouse, children, guardians, heirs and next of kin, and any legal and personal representatives, executors, administrators, successors and
assigns), acknowledge that I have signed this Agreement without any inducement, assurance or guarantee, and intend for my signature
to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this Agreement. This
Agreement represents the complete understanding between the parties regarding these issues and no oral representations, statements
or inducements have been made apart from this Agreement. If any provision of this Agreement is held to be unlawful, void, or for any
reason unenforceable, then that provision shall be deemed severable from this Agreement and shall not affect the validity and
enforceability of any remaining provisions.

起訴権利放棄及び免責事項同意書

USA Track & Field, Inc.（以下、USA Track & Fieldとする）が公認し、セドナ商工会議所（以下、本大会主催者とす
る）が主催するセドナマラソン2014（以下、本大会とする）に参加するため、私は私の配偶者、子供、保護者、
相続人および近親者、さらには法的代理人に代わり、下記に記載される訴訟の権利放棄およびいかなる危険の認
知や損害補償義務の免責に関して合意します。
1.私は(i)本大会の開催時に満18歳以上であり、(ii)本大会に参加するために十分な健康状態であること、なおかつ
(iii)安全に本大会へ参加するため、飲酒や非合法薬または処方薬の使用による影響下にない状態であることを認め
ます。また、私が本大会に参加できる十分な健康状態にあると判断することは、私自身の責任に帰属することを
同意します。さらに、私は本大会の開催期間中における私自身の安全や健康状態の管理を自己責任のもとで行う
ことに同意します。
2.私は陸上競技、ロードランニング、レースウォーキング、クロスカントリー、マウンテンランニング、ウルト
ラランニング、そしてトレイルランニングとしての本大会には本質的な危険性がともない、私自身に肉体的や精
神的な影響を及ぼす可能性があることを理解し、認識しています。また、私は本大会への参加および本大会にお
ける陸上競技に関する活動に、重大な身体傷害および病気や疾患、後遺障害、麻痺や人命損失、本大会にかかわ
る機器や所有物の損失および棄損、他の競技者や観戦者、動物、または自然および人工物との接触事故、天候不
良に起因する危険、不完全なコースの状態にかかわる危険、設備の不備や安全対策の不十分、競技者の能力レベ
ルの差異、本大会主催者が直ちに制御できない状況、その他の予知不可能で未定義のあらゆる危険（これらを以
下、リスクとする）が起こる可能性があることを理解し、認識しています。私はこれらのリスクのすべてや一部
分が、私自身もしくは他の参加者の行動や無行動、もしくは過失行為や不行為によって引き起こされる可能性が
あることを理解しています。また、私は本大会に参加することによって生じるいかなる危険や損害、負債、損失
に対する責任が私に帰属することを理解し、認識します。
3.私はUSA Track &Fieldが定める競技ルールやその他の安全規定に従うのみでなく、本大会に関連するルールや規
制を熟知および順守することに同意します。加えて、私は本大会に参加中のいかなる行為や行動は私自身の責任
に帰属することを認識しています。
4.私は本大会に関連するいかなる事故や損失について、大会にかかわるいかなる個人や組織（本大会本部、本大
会主催者とそのメンバー、USA Track&Fieldとそのメンバー、本大会運営関係者、ボランティアスタッフ、本大会
医療スタッフ、プロモーター、スポンサー、広告主、本大会関連施設、不動産所有者、関連エージェント各社と
そのメンバー等）に対する損害賠償等の請求、要求、訴訟の権利を放棄し、免責することに同意します。さらに
私は、本同意書に関わらず、私自身もしくは代理人が本大会関係者に対して責任追及の主張を起こした場合でも、
損害賠償等の請求、要求、訴訟の権利を放棄し、免責することに同意します。
5.自己都合による申込後のキャンセルおよび過剰入金や重複入金による返金が不可であることに同意します。
6.本大会の映像や写真、記事または記録等（において氏名や年齢、性別、および記録や肖像等の個人情報）が、
新聞、テレビ、雑誌、インターネットまたはパンフレット等に、報道、掲載もしくは利用されることを承諾しま
す。また、その掲載権および使用権は本大会主催者に属します。
7.本大会は、上記の申込規約のほか、本大会主催者が別途定める大会規約に則ります（齟齬がある場合は大会規
約を優先します）。
私は本同意書をよく読み、その内容や条件を理解し、本大会に関する訴訟の権利放棄およびいかなる危険の認知、
さらには損害補償義務の免責に合意するため、本同意書に署名をすることができる法定年齢に達していることを
認めます。私は本同意書に関し、完全な理解および認識を示し、本同意書は口頭主張や予備申し立てに影響され
るものではないことを認めます。
