.xxxとは何だったか？
• 2003年のTLD追加第2ラウンドで応募された。
• オンラインアダルトエンターテイメント業界向け
として申請されたスポンサードTLD
– スポンサードTLD (sTLD) == “特定のコミュニティ
にドメイン名を提供することを目的とする” TLD
– 明確に定義されたコミュニティ(clearly defined
community) によるスポンサーが必要
– スポンサー：コミュニティがTLD運営を後援すること
• アダルトと明示するTLDということで、物議に。

• 2005年ICANN理事会は、一旦.xxxの応募事
業者(ICM Registry) との契約条件交渉開始
が決議。
• その後2006年から2007年の議論の末、一転
して、.xxxの応募が却下された。
• 2008年にICM Registryが独立審査パネル
(IRP: Independent Review Panel) に提訴
• 2010年2月、IRPがICM勝訴を決定
• 現在.xxxの取り扱いに関してパブコメ中

独立審査結果に至る背景
• GAC，米国政府，パブリックコメントなどから、アダルトコンテ
ンツ用TLDの是非という観点から、懸念が相次いでいた。
• ICANN理事会は、上記懸念を大きく捉える立場，技術的任務
とプロセスを重んじる立場に分かれる中、常に票が割れる決
議であった。
• 2005年6月1日のICANN理事会の「契約交渉開始」決議が、
「要件充足決議」であるか、「要件充足は未決」であるかが、争
点であったが、「要点充足決議である」とIRPは判断した。

Consideration of the .XXX (ICM) sTLD Registry Agreement

John Jeffrey introduced ICM’s proposed version of the .XXX Registry Agreement and various
board members and staff entered into a detailed discussion of the following points: agreement
terms against the application statements and promises made by ICM in support of their
proposal; concerns regarding ICANN’s ability to enforce the promises made by ICM through a
contractual framework and the potential harm if such enforcement could not be maintained; the
sponsorship criteria in the RFP and materials submitted in support by ICM and others;
community input including letters and emails from industry and consumers regarding the
proposed sTLD; GAC advice contained in the GAC Communique from the Wellington Meeting
and whether the terms of the proposed agreement achieved the terms of that advice; and
ICM’s submission and supporting letters and documentation.
Vanda Scartezini moved for a vote, and Peter Dengate Thrush seconded a motion on to
approve the proposed .XXX Registry Agreement as submitted by ICM.
ICANN's Board voted 9 to 5 against the proposed agreement. Votes in favor of the
proposed .XXX Registry Agreement were cast by the following Board Members: Veni
Markovski, Susan Crawford, Peter Dengate Thrush, Joichi Ito, and Mouhamet Diop. Directors
who voted against the approval were Vint Cerf (Chairman), Alejandro Pisanty (Vice-Chairman),
Raimundo Beca, Demi Getschko, Hagen Hultzsch, Njeri Rionge, Vanda Scartezini, Paul
Twomey (President and CEO), and Hualin Qian.

Proposed sTLD Agreement with ICM Registry

Whereas, on 15 December 2003, ICANN solicited proposals from potential sponsors to create
new sponsored top-level domain (sTLD) registries, seeking applications that would “address
the needs and interests of a clearly defined community (the Sponsored TLD Community),
which can benefit from the establishment of a TLD operating in a policy formulation
environment in which the community would participate.”
Whereas, on 19 March 2004, ICM Registry, LLC (ICM) submitted an application for the
delegation of a .XXX sponsored TLD (“sTLD”) (the “ICM Application”) which was evaluated
according to ICANN's designated sTLD processes.
Whereas, on 1 June 2005, the ICANN Board voted 6-3 with two abstentions to authorize the
President and General Counsel to enter into negotiations with ICM relating to proposed
commercial and technical terms for the .XXX sTLD.
Whereas, on 9 August 2005, ICANN posted a draft proposed .XXX sTLD registry agreement
on the ICANN website.
Whereas, on 15 September 2005, the Board voted 11-0 with 3 abstentions expressing
concerns regarding issues relating to compliance with the proposed .XXX sponsored TLD
registry agreement (including possible proposals for codes of conduct and ongoing obligations
regarding potential changes in ownership) and, noting that the Board had received extensive
public comments, directed the ICANN President and General Counsel to discuss possible
additional contractual provisions or modifications for inclusion in the .XXX registry agreement
so as to ensure that there were effective provisions requiring development and implementation
of policies consistent with the principles in the ICM application.
Whereas, on 18 April 2006, a revised draft proposed .XXX sTLD registry agreement was
posted by ICANN on its site, and ICANN requested and received extensive public comment on
this agreement.

Whereas, on 10 May 2006, at the specific request of the applicant the Board reviewed the
revised draft proposed .XXX sTLD registry agreement and the motion to adopt the proposed
agreement failed by a vote of 9 to 5.
Whereas, on 19 May 2006, the applicant submitted a request for reconsideration
<http://www.icann.org/committees/reconsideration/icm-06-4/petition-20may06.pdf>. On 29
October 2006, ICM withdrew its reconsideration request and resumed negotiations in an
attempt to agree to a new version of the proposed agreement for Board consideration.
Whereas, on 5 January 2007, ICM negotiated a further revised draft .XXX sTLD registry
agreement (“Revised Agreement”), which was posted by ICANN and received extensive public
comment on the Revised Agreement.
Whereas, the Board has received and analyzed unprecedented public comment, as well as
advice from the GAC via communiqués issued in Wellington and in Lisbon, relating to ICM’s
Application and the Revised Agreement.
Therefore, the Board has determined that:

ICM’s Application and the Revised Agreement fail to meet, among other things, the Sponsored
Community criteria of the RFP specification.
Based on the extensive public comment and from the GAC's communiqués that this agreement raises
public policy issues.
Approval of the ICM Application and Revised Agreement is not appropriate as they do not resolve the
issues raised in the GAC Communiqués, and ICM’s response does not address the GAC’s concern for
offensive content, and similarly avoids the GAC’s concern for the protection of vulnerable members of
the community. The Board does not believe these public policy concerns can be credibly resolved with
the mechanisms proposed by the applicant.
The ICM Application raises significant law enforcement compliance issues because of countries' varying
laws relating to content and practices that define the nature of the application, therefore obligating
ICANN to acquire a responsibility related to content and conduct.
The Board agrees with the reference in the GAC communiqué from Lisbon, that under the Revised
Agreement, there are credible scenarios that lead to circumstances in which ICANN would be forced to
assume an ongoing management and oversight role regarding Internet content, which is inconsistent
with its technical mandate.
Accordingly, it is resolved (07.18) that the Proposed Agreement with ICM concerning the .XXX
sTLD is rejected and the application request for a delegation of the .XXX sTLD is hereby
denied.

29. The volte face in the position of the United States Government evidenced by
the letter of Mr. Gallagher appeared to have been stimulated by a cascade of
protests by American domestic organizations such as the Family Research
Council and Focus on the Family. Thousands of email messages of identical text
poured into the Department of Commerce demanding that .XXX be stopped.
Copies of messages obtained by ICM under the Freedom of Information Act show
that while officials of the Department of Commerce concerned with Internet
questions earlier did not oppose and indeed apparently favored ICANN’s approval
of the application of ICM, the Department of Commerce was galvanized into
opposition by the generated torrent of negative demands, and by representations
by leading figures of the so-called “religious right”, such as Jim Dobson, who had
influential access to high level officials of the U.S. Administration. There was even
indication in the Department of Commerce that, if ICANN were to approve a top
level domain for adult material, it would not be entered into the root if the United
States Government did not approve (C-165, C-166.) The intervention of the
United States came at a singularly delicate juncture, in the run-up to a United
Nations sponsored conference on the Internet, the World Summit on the
Information Society, which was anticipated to be the forum for concentration of
criticism of the continuing influence of the United States over the Internet. The
Congressional Quarterly Weekly ran a story entitled, “Web Neutrality vs. Morality”
which said: “The flap over .xxx has put ICANN in an almost impossible position. It
is facing mounting pressure from within the United States and other countries to
reject the domain. But if it goes back on its earlier decision, many countries will
see that as evidence of its allegiance to and lack of independence from the U.S.
government. ‘The politics of this are amazing,’ said Cerf. ‘We’re damned if we do
and damned if we don’t.’ (C-284.)
