the two lotsandexistinghouseon lot#6. ShannonCopassaidthatall the
correctionsthat he requestedwere madeand he recommended
approvalofthe

DavidJackson told the commifteethat the Townof Kimballhas passedthe

BuildingCodesin placeof the SouthernBuildingCodes.
Mr. Jacksonreportedthatthe signvariancerequestedby the Battlecreek
Tabemacleof Praisewas denied. Theywill removethe existingmonumentsign
and placeit withinthe specifiedsetbacks;alsothe heightregulationswill haveto
be met.
He also reportedthat the plansfor KimballFireworksFestivalday are
progressing
well.

thanthe simpleinteriorlot lineremovalrequest.In his opinionwhena Planning
Commissionmeetingis calledplat approvalwouldbe studiedby Committee,Kimball
Stafiand LocalPlanner.Thisnumberof examiners
wouldreducethe likelihood
of

hadaskedfor information
regarding
minor
subdivisions

shouldhavethe
additionof Section4 of the resolutionwhichaddingMarion County Division of
GroundwaterProtectionCertificateof SewageDisposal certificateon platsfor
subdivisionsrequiringsubsurfacesewagedisposal.Thiswouldalsobe presentedat
the publichearing.The certfficateis alreadyrequiredbut the Subdivision
Regulationsneedto reflectthis additionalcertificate.

Submissionof Preliminaryand FinalPlatsfor lot #20 on CarterlYilson Drive off
DixieLeeCenterRoad(C-2zone). CharlieShearer,surveyorand LouiseWilkey
representingthe purchaserpresentedthe plat.
MayorJacksonaskedCharlieShearerif therewas a possibilityof gettinga sewer
lineto lot#18 and Mr.Shearerresponded
thatan easement
to allowthat. Mayor
Jacksonstatedthat that wouldbe donewhileseryicewas beingextendedto Lot
#20. The otherlots in this subdivisionare accessiblewithoutan easement.Mr.
Shearersaid that he wouldassumethatthe engineerswoulddesignsewerall the
way to Lot #18 then catchLot #20 thenfollowthe interstateROW. MayorJackson
explainedthat therewouldbe a 2" waterlinebroughtin for consumptionand a 6"
waterlinefor fire protection.Thiswouldextendfromthe 12"lineto Lowe'sthat
wouldhaveinadequateflowfor consumptionthereforethe 2" waterlinewouldbe
necessary.Therewas alsodiscussionby AldermanCastleregardinga 50'
easementoff of Lot #20 towardsKimballLane. LouiseWilkeyexplainedthat it was
an old Farmeasementexclusiveto Mr. Carter,Mr. Wilsonand theirheirs. Withthe
heirsnot havingany landadjacentto this easement,it wouldbe a dead-end
easement.K. Featherstonsuggestedthat it shouldbe deededbackto the property
owner.
K. Featherstonstatedthat "Proposed"(indicatingthe roadname)shouldbe takenoff
the final plat and that it couldbe simplymarkedout.

Minutes for the August 15,2006 meeting were reviewed by members.
Joyce Tate made the motion to accept the minutes as read with Char Cheaves
seconding the motion. All voted aye
Members discussed the date of November's meeting which would possibly
conflict the Thanksgiving holiday. It was decided to plan November's meeting for
the 14'~.
Members reviewed and discussed a proposed resolution regarding the way
minor lot line adjustments are approved by the Town of Kimball. This would&o
affect small subdivisions in which one piece of property changes an interior lot
line. These changes only could be reviewed by Shannon Copas, the planning
advisor and Ronnie Blevins, building inspector for approval. In these instances

meeting of the Planning Commission members would not be necessary.
The Planning Commission would be made aware of the presentation, also the
approval or disapproval of same. This resolution would also include adding a
signature line for Marion County Ground Water Protection Certificate to all future
plats.
A motion was made by Joyce Tate to adjourn the meeting and second was
made by Emily Layne.
Following the close of the meeting Shannon Copas presented a training
session to complete the mandatory 4 hour training required by the State of
Tennessee.

Disrussion on Subdivision Regulation Amendments for Corrective Plat
Procedures and to Include the Marion County Division of Groundwater
Protection Certificate of Sewage Disposal
At the August Planning Commission meeting it was discussed that the Town
of ILimball should adopt a Corrective Plat Procedure. Staff has drafted a
resolution that outlines these procedures, and, before the Planning
Conmission proceeds with adopting these regulations, Statf would like the
Conunission to look them over one more time before a public hearing is held.
Tlle procedures for this process are contained within the attached Resolution.
Plats that meet these standards will no longer have to come before the
Planning Conlmission for review, but can be Staff approvt:d. Prior to this
resolution, the Planning Commission will have to hold a public hearing to
receive public comments before it can be adopted. According to the Agenda,
the public hearing will take place after the reading and approval of the
minutes.

A RESOLUTION TO AlMEND THE KIMBALL MUNICIPAL SUBDIVISION
REGULATIONS: CORRECTIVEIREVISEDPLAT PROCEDURES AND TO
AMEND THE REGULATIONS OF FINAL PLAT SPECIFICATIONS AND
CERTIFICATIONS REQUIRED.
WHEREAS, ptlr!;uant to 'l'ennmsee Code Annotated Seclio~l 13-4-303 municipal
subtlivision regulations have been adopted for the Town of Kimball; and
WWEREAS, the Kimball Municipal Plauuug Commission has agreed to define Major and
Minor Subdivisions and establish Minor Subdivision - Plat Procedures and
include additional certifications; and
WHEREAS, pursuant to Tennessee Code Annotated, a public hearing was held before this
body on
,2006, pursuant to a notice published in the South Pittsburg
Husr.ler;
NOW, TIIEREFOEE, BE IT RESOLVED BY THE KIMBALL MUNICIPAL PLANNING
COMMISSION:

SECTION I. That the Kiball Municipal Subdivision Regulations, Clhapter 8 (Final
Platting Requirements), Section 8.06 -1at
Procedure) be
deleted in its entirety and replaced with the following:
A.
Minor Subdivision A - Plat Procedure
Whenever a proposed subdivision contains four (4) or less lots and
does not require the construction or installation of new streets, utilities
or other improvements, the following procedures for review and
approval of the subdivision shall apply. The subdivider may, if he
desires, submit only a fulal plat in securing plat approval provided that
the plat submitted complies with all the requirements of the final plat.
However, if any corrections or modifications are needed, the Planning
Co~nmission shall disapprove the plat and require that it be
resubmitted for approval. Submission of a preliminary plat is optional
unless topographical or other features justifjr submission as determined
by the Planning Commission. If required, the preliminary plat must
meet all standards contained in Chapter 6 of the Kimball Municipal
Subdivision Regulations.

The purpose is to facilitate the re-recording of existing plats with
minor shifting of lot lines and refer to Section 8.05 ~orrectivelRevised
Final Plat Certificate.

Qualifications for Corrective andlor Revised Final Plats
1.
Minor shifting of lot lines among two lots,
2. CorrectivelRevised Final Plats 31all not include
plats that contain new roads, utilities (i.e. water
and sewer) and variance requests from the
Kimball Subdivision Regulations.

Corrective Plat andlor Revised Final Plat Procedure
1.
The corrective andlor revised plat shall be
submitted for review and approval in accordance
with the final plat requirements as stated within
Chapter 8 of these regulations.
2.
The plat must be drawn to the size and format
requirements as stated within Chapter 8 of these
regulations.
3.
The plat shall be drafted so that good, clear, legible
prints, copies, or negatives can be made.
Corrective Plat andlor Revised Final Plat Requirements
The following are required for Corrective andlor Revised
Plats in addition to the minimum requirements found in
Chapter 8, Section 8.04 for Final Plats.
1.
Subdivision name that reflects the change, (e.g.
re- subdivision of lots 25 through 29 and lots 43
and 44, Highland Estates).
2.
Purpose statement that tells the exact purpose of the
plat andlor change (e.g. Purpose of Plat: to abandon and
show new property lines between lots 25 through 29,
and to abandon the drainage easement and relocate it as
shown on lots 43 and 44. See Marion County Register
of Deed Book, pg.
for previous recording and for
other notes and restrictions).

NOTICE OF
PUBLIC HEARING
In accordance with Tennessee Code Annotated (TCA) 13-4-303, notice is hereby given of a
public hearing by the Kimball Municipal Planning Commission to be held on Tuesday,
,2006 at 6:00 p.m. in the Kimball Town Hall. The purpose of this hearing is
to receive public comments on a proposed amendment to the Kimball Subdivision
Regulations that would establish a procedure to submit, review, and approve
correctivelrevised final plats. The proposed amendment would also require subdivision plats
to contain a CorrertivelRevised Final Plat Certificate signed by Town Staff to ensure the
plat meets the Subdivision Regulations of Kimball, Tennessee. Also, the amendment would
require plats to contain the Marion County Division of Groundwater Protection
Certificate of Sewage Disposal to ensure septic tanks that will be used fix waste disposal
will hnction properly. Also, copies of the proposed amendment are available at Kimball
Town I-lall during normal business hours. All interested persons are invited to attend and
comment.

With the final plat in view by all members M.O'Leary questioned if any of this four

lot subdivision was in the flood plain. David Jackson stated that lot #
road would enter Old Dixie Highway was in the flood plain. The road end was
also questioned. Danny Dancy stated that it would dead end as far as the Town
of Kimball was concerned. There would be another road meet it that would not
be dedicated to Kimball. Provision of Water gas and electric was questioned by
Jay Totten. All three utilities were approved on the plat. There will also be a fire
hydrant installed. Mr. Brannigan (property owner) will be responsible for
installation of the hvdrant. Road identities have been addressed on the final ~ l a t .
D. Dancy stated that he would get an elevation certificate on the portion that is
possibly in the flood zone. The suspected flood zone area will not have a
building on it as it is at the edge of the lot. M.OILeary suggested that a notation
be made on the plat regarding this area being in the flood zone. The notation
was added to the plat, item #13, notes section. Mr. Brannigan plans to use a
culvert across the street and a swale leading to the creek to avert a water
problem on neighboring lots. M.O'Leary stated that the plat was corrected as
recommended by Shannon Copas, Planner. Also there is a letter of credit for the
road construction
Jay Totten made the motion to approve this final plat with notations added that a
portion of the property lies within the flood plain and also that lots 1-4 restricted to
3 bedroom houses. Second was made by Rance Castle and All voted aye.
With no further business to discuss David Jackson made the motion to dismiss
and Mark O'Leary seconded the motion. Meeting was adjourned.

Jordan's Lane - Preliminary Plat Approval Request (OwnerDeveloper
James Hurst) Near the Intersection of Water Front Place and a Proposed
Jordan's Way in a R- 1, Low Density Residential District
This is a thirteen-lot subdivision located off of a proposed Jordan's Way in
the Rivers Edge Subdivision. Jordan's Way will connect with Water Front
Place in an R-1, Low Density Residential District. The Owner of this
development is James Hurst, according to the proposed plat. Staff
reviewed the proposed plat prior to the meeting and sent the Surveyor a
copyllist of recommendations concerning the above-mentioned plat. Refer
to the attachment for a list of recommendations that were sent to the
Surveyor and to the Kirnball Town Staff for review.

Minutes from October 17.2006were read by members and Joyce Tate made
the motion to approve them with the exception of the word "only" in the Members
review of the approval procedures for minor subdivisions. The sentence is "In
these instances e ~ l ay meeting of the planning commission members would not
be necessary." Second was made by David Jackson and All voted aye
Minutes from the October 30.2006 Special Called meeting were read by the
members. Motion was made by Joyce Tate to approve the minutes as read. All
voted aye.
OLD BUSINESS:
Resolution to adopt "Corrective Plat Procedures" and "Ground Water
Protection Certificate of Sewage Disposal".(This signature would be added to
the required signatures on plats submitted for approval and would be added to
the Subdivision Regulations.)
Shannon Copas discussed the corrective plat procedures. The resolution will
allow staff to review and approve or disapprove corrective plats in which there
are minor shifts in lot lines. These plats will still be required to furnish all required
signatures and any noted corrections will have to be made beforeapproval is
given. The purpose of this resolution is to reduce the number of meetings of the
Kimball Planning Commission. The Planning Commission will be informed of
each plat that is submitted to staff.
It was noted that adoption of this resolution was advertised in local newspapers
for 15 days prior to this meeting.
Rance Castle made a motion to approve this resolution as written...Second was
made by Joyce Tate. All voted aye
David Jackson questioned a plat that had been tentatively submitted for 13 lots
on a proposed extension of Water Front Place. The owner has since delayed
presentation of the plat. The development is called Jordan's Way.

Tractor Supply Minor lot line change. Tractor Supply had already submitted a
final plat which was approved. They are expanding the lot size on the NE side to
accommodate the building and setback lines. This also affects the NW lot line of
lot 20. The property owners are presently out of town, but agent, Louise Wilkey
has planned to Fed-ex plats to the owners for sighatures, as soon as they return.
Shannon Copas stated that the plat was correct
David Jackson made the motion to approve the plat when all signatures are in
place, including the power board and 911 director. After all signatures are
obtained the plat will be taken to the Court House by Kimball staff to be recorded.
Second was made by Mark O'Leary and all voted aye.
Shannon Copas presented a review of his activities concerning Kimball since
the last meeting.
Mayor Jackson wished everyone a happy Thanksgiving. Mark O'Leary
extended congratulations to Char Cheaves on the birth of her twin arandsons.

meeting is called in December. It was agreed that 6:OOpm would be best.

REGULATIONS: CORRECTZVE/REVISED PLAT PROCEDURES AND TO
M N D TBE REGULATIONS OF FWAL PLAT SPECIlFICATIONS AND
CERTIFIcAnoNs REQUIRZD.
WHEREAS, pursuant to Tennessee Code Annotated Section 13-4-303 municipal
subdivision regulations have been adopted for the Town of Kimball; and
WHEREAS. the Kimball Municipal Planning Commission has agreed to defme Major
and Minor Subdivisions and establish Minor Subdivision - Plat
Procedures and include additional certifications; and
WHEREAS, pursuant to Tennessee Code Annotated, a public hearing was held before
this body on NOV 1% 2006, pursuant to a notice published in the South
Pittsburg Hustler;
NOW, THEREFORE, BE IT RESOLVED BY THE KIMBALL MUNICIPAL
PLANNING COMMISSION:
SECTION 1. That the Kimball Municipal Subdivision Regulations, Chapter 8 (Final
Platting Requirements), Section 8.06 (Minor Subdivision - Plg
Procedure) be deleted in its entirety and replaced with the following:

Minor SubdivisionA - Plat Procedure
Whenever a proposed subdivision contains four (4) or less lots and
does not require the construction or instaIlation of new streets,
utilities or other improvements, the following procedures for
review and approval of the subdivision shall apply, The subdivider
may, if he desires, submit only a final plat in securing plat approval
provided that the plat submitted complies with all the requirements
of the frnal plat. However, if any corrections or modifications are
needed, the Planning Commission shall disapprove the plat and
require that it be resubmitted for approval. Submission of a
preliminary plat is optional unless topographical or other features
justify submission as determined by the Planning Commission. If
required, the preliminasy plat must meet all standards contained in
Chapter 6 of the Kimball Municipal Subdivision Regulations.

Minutes of the November 14, 2006 meeting were read and a Motion was made
by David Jackson to approve them as written. Second was made by Joyce Tate,
and all voted aye.
OLD BUSINESS: None

NEW BUSINESS;
Jordan's Way - Preliminary Plat Approval Request (OwnerlDeveloper James
Hurst). This property is in a 1-1 zone and is located near Intersection of Water
Front Place and a proposed street, Jordan's Way .
This subdivision was discussed at great length. Shannon Copas stated
that lots number 11 thru 13 do not meet the Town's ordinance requirements
regarding long narrow lots- the 3 to 1 ratio. As platted the developer would have
to request a variance on these three lots. It was also pointed out that the zoning
is 1-1 which is Industrial. That would have to be changed to R-I. The plat did not
have elevation contours which would be necessary.
The committee discussed the surrounding property owners and the impact
on their land, if the elevation of Mr. Hurst's land it augmented. There also is a
natural drainage area in question that is very close or in this particular property.
The question was raised regarding Tennessee Department of Environmental
Control, and their possible denial of this land being used for housing.
A Motion was made by Jay Totten to deny approval of this preliminary on
the following grounds:
1. Developer should contact TDEC requesting that they review the
feasibility of this Project considering flood and sewer problems
2. The plat should be presented with elevations showing.
3. The three lots not in 3-1 ration compliance be changed (Kevin
Featherston did not recommend approval of a variance)

4. Developer will comply with Kimball's ordinance #98 regarding
land in the flood areas
5. Developer will request a zone change to R-1 from 1-1.
Second was made by Joyce Tate and All voted aye.
TRACTOR SUPPLY Submitted a site plan for their proposed business off Dixie
Lee Center Road on Proposed Carter-Wilson Road in the C-2 zone. Shannon
Copas was not able to give a written recommendation due to a time factor. He
said that roadway is in place as a bond is in escrow for the road. There would be
83 parking places instead of the ordinance requiring 111. David Jackson asked,
if it would seem to be a problem. Jay Totten said that he had been to several
Tractor Supply locations and crowding in the parking lot did not appear to be a
problem. Shannon Copas said that would be acceptable, since there did not
seem to be a future problem with the number of parking spots. David Jackson
showed the committee the setup for water, sewer, gas, and electric facilities.
There was discussion on elevation of the property in regards to the flood plain.
Shannon Copas explained that when a building permit was obtained this would
be addressed. It should not be an issue on the site plan. In summary Mr. Copas
suggested that Tractor Supply go by Kimball's flood damage prevention orders in
building their site. David Jackson explained that the site plan showed drainage
from high water would be directed away from nearby home owner.
Rance Castle made a Motion to approve the site plan. Second was made by
Joyce Tate. All voted aye.
Shannon Copas reviewed his activities for Kimball during the last month.
Praises were spoken by Mr. O'Leary and all to the local fire fighters and
policemen for the valiant efforts during the recent fire and loss of three children's
lives.
Chairman O'Leary wished all a Merry Christmas and asked for a motion to
adjourn. Motion was made by Rance Castle to adjourn with Second by Joyce
Tate. All vote aye and meeting was adjourned
