[*953] GINSBURG, Circuit Judge: The Publicity in Taking Evidence Act of 1913 provides
that depositions of witnesses for use in any suit in equity brought by the [**2] Government under
the Sherman Act "shall be open to the public as freely as are trials in open court." 15 U.S.C. ｧ 30.
Microsoft Corporation, the defendant in such an antitrust case, appeals the district court's order
requiring the depositions in this case to be taken in public, subject to provisions for the protection of
trade secrets and other confidential business information. Microsoft argues that the "depositions"
referred to in the statute are not the depositions known today under the Federal Rules of Civil
Procedure, namely, interrogations undertaken for the purpose of pretrial discovery. In the alternative,
Microsoft argues that ｧ 30 conflicts with and is superseded by the standard for granting a protective
order under Rule 26(c).

3.1) Public Laws
Public Laws 内容
法案が連邦議会で可決し制定法として施行される場合、
まず slip laws として当該法律の文書を記載するパンフ
レットの形式で発行されます。これは Public Law と呼
ばれ、例えば P.L.107-204 といった番号が付されます。
Public Laws 番号を伴うタイトル部分（heading）、承
認日、法案（bill）番号、立法履歴、及び United States
at Large の番号（議会セッションごとに可決した法案
をまとめたもの。次ページ参照）が含まれます。また、
大統領が拒否権を発動したり署名を行わずに法案が
制定された場合には、その旨記述されます。
ハイフンの前の番号はその法律を議決した議会の番
号であり、後ろの番号は当該議会における法律の連
番を表わします。

It shall be unlawful for any registered broker or dealer, member of a national securities exchange, or
broker or dealer who transacts a business in securities through the medium of any member of a
national securities exchange, directly or indirectly-(a) In contravention of such rules and regulations as the Commission shall prescribe for the protection
of investors to hypothecate or arrange for the hypothecation of any securities carried for the account of
any customer under circumstances (1) that will permit the commingling of his securities without his
written consent with the securities of any other customer, (2) that will permit such securities to be
commingled with the securities of any person other than a bona fide customer, or (3) that will permit
such securities to be hypothecated, or subjected to any lien or claim of the pledgee, for a sum in
excess of the aggregate indebtedness of such customers in respect of such securities.

This section is effective Oct. 1, 1934, as provided by Act June 6, 1934, ch 404, Title I, § 34, 48 Stat.
905, which appears as 15 USCS § 78hh.
Amendments:
1975. Act June 4, 1975 (effective 6/4/75, as provided by § 31(a) of such Act which appears as 15 USCS § 78b
note), in the introductory matter, inserted "registered broker or dealer,", deleted "any" preceding "broker or
dealer who", deleted "such" following "medium of any", and inserted "of a national securities exchange";
deleted former subsec. (b) which read: "To permit in the ordinary course of business as a broker his aggregate
indebtedness to all other persons, including customers' credit balance (but excluding indebtedness secured by
exempted securities), to exceed such percentage of the net capital (exclusive of fixed assets and value of
exchange membership) employed in the business, but not exceeding in any case 2,000 per centum, as the
Commission may by rules and regulations prescribe as necessary or appropriate in the public interest or for
the protection of investors."; redesignated former subsec. (c) as subsec. (b); and redesignated former subsec. (d)
as subsec. (c), and inserted "or in contravention of such rules and regulations as the Commission shall
prescribe for the protection of investors".

Contrary to petitioners' argument that an absence of debate about state-court suits rendered the
historical record unenlightening, the Court deemed such silence to underscore the ubiquity of
eighteenth-century assumptions about state sovereign immunity. ... When the Court returned in Alden
to the interaction of the same federal system with the same federal law, however, the Constitution led
the Justices to find a sphere of sovereign immunity broader than that of state sovereignty - an
immunity that swallowed the most effective remedies for the very rights made enforceable against the
states by Garcia. ... The irony of Justice Kennedy's invocation in Alden of that earlier language is not
hard to capture; having conceded the substantive authority to create federal rights to certain state
employment benefits, the Alden Court could deploy federalism only as a tool by which to frustrate the
vindication of those rights, and to condone the incursion by state sovereign immunity into the

A. Constitutional Structure
1. Federalism - State Sovereign Immunity in State Court.
- Propelled by the "ever-whirling wheels of American federalism," n1 the Rehnquist Court has offered a
forceful answer to those who questioned whether it could generate a consistent, overarching theme.
n2 Emerging from the Court's decisions over the last seven years - and taking polished shape on a
single day last June - is a constitutional structure designed around a rigid federal frame. The Court
placed the "capstone" n3 on that structure last Term, holding in Alden v. Maine n4 that state sovereign
immunity prevents Congress acting under its Article I powers from subjecting a nonconsenting state to
private suits for damages in its own courts. n5 By focusing their efforts on extensive and ultimately
unproductive historical analyses, however, both majority and dissent obscured the true import of the
Court's decision: that the method of expanding state autonomy in Alden clashes with basic
constitutional elements of the federal system.

検索を行い、画面上部（真中）にある”Save As
Alert”をクリック。
また、設定の変更や削除等も可能。
配信設定画面で、Alert 名、配信頻度、配信方法
等を設定。
Frequency ： 更新の頻度を選択
Delivery ： email 配信か、画面上での確認かを選択
Email 配信の場合は、アドレスを入力
Email Option ： 文書の形式など詳細の設定が可能
Notification ： 通知メールを希望する場合はチェック
青字のところをクリック。
6) ダウンロード・印刷
検索を行い文書が表示されてから、画面右上の
プリンター・フロッピー・Email のマークのいずれか
をクリック。
文書のフォーマットや形式、対象範囲を選択
し、”Download”ボタンをクリック。
“開く”または“保存”を選択し、文書を確認
